By supplying film or other materials to ACCORD, it’s dealers, customers, or agents acknowledges and agrees that ACCORD’s liability for any loss, damage or delay to film during the processing service will be limited to the replacement cost of a non-exposed roll of film and/or blank videocassette of similar size/length. Except for such replacement, ACCORD shall not be liable for any other loss or damage, direct, consequential or incidental, arising out of customers use of ACCORD’s service. Customer further agrees to hold harmless and to indemnify ACCORD from any legal action against ACCORD alledging copyright infringement as a result of ACCORD performing services for the buyer. Customer attests that he/she is the commensurate with the quality of the film or videotape original you supply. |
